The ASPW Experience : Client Agreement 

 

Terms and Conditions for ASPW Experience Subscription

Parties:  

  • Provider: ASPW Experience ("ASPW")

Service Description:

ASPW Experience offers a three-tiered private community subscription for fans of his work.

  1. Acceptance of Terms:

By subscribing to any tier of the ASPW Experience, the Client agrees to be bound by these Terms and Conditions.

  1. Subscription and Payment:
  • Subscription Tiers: Clients may choose from tier One, tier Two, or tiers Three, each with different benefits as described on the ASPW Experience website.
  • Payment: Subscription fees are charged according to the selected tier at the beginning of each billing period. 
    • One: $5.00 per month OR $50.00 per year.
    • Two: $24.00 per month OR $264 per year.
    • Three $250 per month OR $3000 per year.

  • Billing Cycle: 
    • Monthly or annually, depending on the subscription choice.
  • Payment Method: Payments must be made through the payment methods accepted by ASPW, which currently include STRIPE & ApplePayl.
  • Non-Refundable: All payments are non-refundable once processed.
  1. Access and Use:
  • Membership Duration: Access to services is granted for the duration of the paid subscription period.
  • Content Access: Clients will have access to the content and services corresponding to their subscribed tier. 
  • Use Restrictions: Clients shall not share, reproduce, distribute, or publicly display any content or services provided by ASPW without written permission.
  • Online Behaviour in the Virtual Fireside Chat: 
    • Clients are expected to maintain respectful and professional conduct in the Virtual Fireside Chat. 
    • Prohibited behaviors include but are not limited to harassment, hate speech, spamming, sharing of personal information without consent, and any form of illegal or unethical activity.
    • ASPW reserves the right to moderate, warn, suspend, or permanently ban users from the Virtual Fireside Chat for violations of these behavioral guidelines.
  1. Termination:
  • By Client: The Client may cancel their subscription at any time; however, no refunds will be provided for the current billing cycle.
  • By ASPW Experience: ASPW reserves the right to terminate or suspend access to the service for violation of these terms, non-payment, or any other reason at ASPW’s discretion without refund.
  1. Modification of Services:
  • ASPW may modify, suspend, or discontinue any aspect of the services at any time, including the availability of any feature, database, or content. ASPW will provide reasonable notice where possible.
  1. Intellectual Property:
  • All content provided by ASPW, including but not limited to text, graphics, logos, images, and videos, is the property of ASPW or its content suppliers and is protected by intellectual property laws.
  1. Privacy:
  • Use of the ASPW Experience is also governed by ASPW’s Privacy Policy, which details how personal information is collected, used, and protected.
  1. Limitation of Liability:
  • ASPW Experience shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
  1. Governing Law:
  • These terms shall be governed by and construed in accordance with the laws of Western Australia, Australia, without regard to its conflict of law provisions.
  1. Changes to Terms:
  • ASPW Experience reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to ASPW’s website. Continued use of the service after such changes will constitute consent to such changes.
